How to Subpoena a Social Worker in California

A subpoena in California is used to force a  person, whether a witness, a party or a nonparty to the case, to appear at a  court hearing. If the person refuses to appear, the person can be held in  contempt of court and ordered to pay a file or to serve time in jail. A social  worker can be an important witness whose attendance should not be  underestimated. Fortunately, California imposes no special requirements to  subpoena a social worker and the process is fairly straightforward.

Things You’ll Need

  • Civil Subpoena for Personal Appearance at Trial or  Hearing

      Acquire a “Civil Subpoena for Personal Appearance at Trial or Hearing” form  from the court clerk.

      Fill in the social worker’s name, address and telephone number (if known) in  the field just above paragraph 1.

      Enter the date and time of the hearing, and the location of the courthouse  where the hearing will be held in the fields below paragraph  1.

      Enter your name and telephone number in the fields below paragraph  2.

    • 5

      Return the completed form to the court clerk and ask the clerk to “issue” the  subpoena. The clerk will sign and date at the bottom of page 1 of the  form.

      Deliver a photocopy of the subpoena to the social worker at least 10 days  before the date of the hearing. Although you may serve the form, it would be  wise to have someone not connected to the case serve the social worker in case  the social worker later denies receiving it. Professional process servers can  serve the document for a modest fee, as can the sheriff’s department. The  process server or sheriff will fill out the second page of the subpoena form  after the form has been delivered. File that form with the  clerk.
