The perjury charge against Special Judge William H. “Bill” Layden Jr., 61, was filed Wednesday.

The judge was fingerprinted and had his photo taken at the Oklahoma County jail, then made his initial appearance on the felony case at the Oklahoma County courthouse.

The multicounty grand jury indicted the judge twice last month. The first indictment against him was filed Friday at the courthouse in McAlester. He and two others are accused in that felony case of conspiring to impede an investigation into missing drug court funds.

The judge has denied wrongdoing. His attorney has said he will not resign.

The drug court program was instituted in Oklahoma in 1995. The purpose is to redirect drug offenders into a structured, judicially monitored substance abuse treatment program rather than sending them to prison.

Grand jurors reported finding a drug court in Pittsburg County that had run amok. The grand jury said drug court participants there had to pay $4,500 — a total “greatly in excess” of the fee provided by law. Participants also were paying the drug court administrator rather than the court clerk.

The grand jury in May indicted the former administrator of the Pittsburg County drug program. Angela Marcum, 39, was accused in that indictment of embezzling more than $27,950 in fees collected from drug court participants. She is suspected of using the money to gamble.

The conspiracy indictment filed Friday was against Layden, Marcum and former drug court prosecutor James Michael “Mike” Miller, 43. Grand jurors alleged the three conspired to hide evidence from investigators and to harass potential witnesses.

Prosecutors have described the prosecutor as having a warm, personal relationship with the drug court administrator, even though she was married.

The former prosecutor, Miller, faces his own perjury indictment. Miller and Marcum also have denied wrongdoing.

In the perjury indictment against the judge, grand jurors alleged he lied twice when he claimed the court clerk refused to accept drug court payments.

“She informed me that couldn’t be done,” he testified in July. Grand jurors said the judge and the court clerk never had such a conversation.
